1. CONSENT TO TERMS AND CONDITIONS

Access to and use of the services of Pegasus Travel Advisors (“Pegasus”) and our website is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using, or obtaining any content, products, or services through Pegasus’ office or website, you, the purchaser/traveler agree to be bound by these terms. PLEASE READ AND AGREE TO THESE TERMS AND CONDITIONS BEFORE USING THIS WEBSITE. These Terms and Conditions govern the relationship between Pegasus and you; and, they restrict your rights and remedies and provide protection to Pegasus. These Terms and Conditions also include warranty disclaimers and liability exclusions. By using this website, you acknowledge and agree (a) this is a fair balance because this website is accessible by you conveniently and at no charge to access the website; and (b) if you do not agree or do not accept these Terms and Conditions, you can choose to not use this website or Pegasus offices. Therefore, if there is anything in these Terms and Conditions, including warranty disclaimers and liability exclusions, with which you disagree or are not willing to be bound by, or if Terms and Conditions Lack something that you consider essential, then you must not use this website or Pegasus’ services. No alterations to these terms and conditions may be made by you or for you by any Pegasus employee, authorized representative, or agent, unless authorized in writing by an officer or qualified and identified representative of Pegasus.

2. TRAVEL DOCUMENTS, INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS

It is your responsibility to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids

Pegasus is not responsible for your compliance with laws applying to your travel arrangements made by or through Pegasus. You will be solely responsible for any failure to strictly comply with all applicable legal requirements, which also may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss flight(s), difficult subsequent scheduled travel bookings on cruises, and tours, and other possible adverse consequences. Check each supplier’s website to ensure you and all members in your travel group or party obtain and carry travel documentation required and comply with all laws applicable thereto.

When you receive any and all travel documents furnished by or through Pegasus, it is your sole responsibility to review and verify all information. Contact Pegasus immediately if changes or corrections are required.

3. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS

Each foreign country governs its entry and exit as well as other legal requirements. They also hold different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. Pegasus neither controls nor warrants the issuance of visas related to applicable travel. It is your sole responsibility to verify that all the visas required for your trip have been obtained, that the visas for each country are valid for the entry and exit dates of your visit, that your personal details are accurately reflected and that your passport is valid as required by applicable law. Even when a visa is issued, a traveler may be denied entry since each country’s local immigration officials make the final entry decision. Several factors, including past criminal record, may contribute to the decision of the local immigration official(s). Should a visa not be issued, Pegasus is not responsible for lost payments made toward the contemplated trip. It is an invasion of privacy for any member of our staff to make such an inquiry. 

4. RISKS/SAFETY

Travel to certain destinations may involve greater risk than others. Pegasus urges customers to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/.

5. NO PEGASUS WARRANTY AGAINST TRAVEL RISKS.

BY OFFERING TRAVEL TO PARTICULAR DESTINATIONS FOR SALE, PEGASUS DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK. PEGASUS SHALL NOT BE LIABLE FOR COSTS, DAMAGES, INJURIES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. YOUR CONSENT HEREIN AND PARTICIPATION IN PEGASUS’ TRAVEL ARRANGEMENTS CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT YOUR SOLE RISK.

6. USE OF PEGASUS TRAVEL ADVISORS ACCESS AND INFORMATION FOR TRAVEL BOOKINGS.

You hereby represent that you are at least eighteen (18) years of age and possess the legal authority to enter into this and other agreements and to make travel bookings with Pegasus by any means, including our website in accordance with all terms and conditions herein. You alone will be financially responsible for all costs and expenses related to your travel bookings (and for use of your account by others, including, without limitation, minors living with you). You agree to supervise all usage of Pegasus communications by minors under your name or account. You also represent and warrant that all information supplied by you or members of your household transacting business with Pegasus is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited and may be legally void. The travel services reservations facilities provided by Pegasus shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act.

Terms and conditions of separate suppliers other than Pegasus may be included in and apply to your reservation and purchase of travel-related goods and services that you select from Pegasus. For your own protection you should familiarize yourself with and abide by all terms and conditions of purchase imposed by Pegasus and any supplier(s) with whom you elect to deal or with whom Pegasus deals on your behalf, including, but not limited to, payment of all amounts when due and compliance with such supplier’s rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of Pegasus’ or any supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase, in your being denied access to any flights, hotels, cruises, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase, and in Pegasus debiting your account for any costs or penalties Pegasus incurs as a result of such violation. You are completely and unqualifiedly responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through access provided by Pegasus. You hereby authorize Pegasus to utilize third-party travel booking sites to fulfill any of your travel requests, ratifying and approving Pegasus’ actions on your behalf, including acceptance of such third party’s terms and conditions, which may limit your rights; and, you agree to be bound by such actions. In the event of any inconsistency or ambiguity of terms, Pegasus is entitled to and will act under the most favorable interpretation of such term(s) in each instance.

7. PAYMENTS AND CANCELLATIONS

Unless otherwise defined during the reservation process, final payment for all arrangements by Pegasus or other suppliers is due prior to departure or consumption according to each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases, there is NO REFUND once a booking is made and paid for. Your right to a refund if you change or cancel your travel plans is limited. All cancellation requests must be sent to Pegasus in writing, according to and within the time limitations for all applicable reservations or arrangements made for you or any member of your group or family by or through Pegasus. As a result of a cancellation, Pegasus’ and all third-party suppliers’ cancellation penalties will apply as detailed in your travel documentation and on Pegasus’ and other suppliers’ websites. Cancellation penalties will be advised at time of booking and provided to you in writing upon confirmation. If you have any questions, or any provisions or penalties are unclear, please contact Pegasus. All cancellation fees will be charged to the credit card you authorized to pay for travel services or deducted from the supplier’s refund.

8. AIR, CHECK-IN, SCHEDULE RECONFIRMATION, AND AIRLINE RESERVATIONS NOT INCLUDED IN TRAVEL PLANS.

Unless you provide such critical information to Pegasus in advance, Pegasus will have no responsibility for same. In case of such changes, it is your sole responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates and returns. Pegasus does not assume any responsibility for any air or ground transportation supplier schedule changes. In rare instances, upon departure from a foreign country, certain departure taxes must be paid in cash only and may vary in price. Due to enhanced security, you should check in a minimum of 2 hours prior to all scheduled departures for domestic flights and 3 hours prior to scheduled departure times for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure times for domestic flights and 72 hours prior to international flights. Failure to confirm or use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares.

9. LATE BOOKINGS

Prospective customers are advised to reserve early to avoid disappointment, additional late booking fees, and other adverse consequences.

10. NO REFUND FOR UNUSED ARRANGEMENTS AND MINIMUM PASSENGER REQUIREMENTS.

Because Pegasus’ prices are based on contract rates, there will not be any refund for any unused portion of a travel booking. Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed, or the tour may be canceled.

11. CURRENCY FLUCTUATIONS

Currency exchange rates fluctuate. Prices are subject to change based upon actual currency exchange rate variations or fluctuations.

12. ALTERATIONS TO CONFIRMED BOOKINGS

If you choose to change any portion of your confirmed arrangements prior to departure or during your trip, Pegasus will attempt to assist you. However, certain bookings may not be able to be changed. Administrative charges of $25 or more per change/per person are possible at time of booking, provided to you upon confirmation, and depend upon circumstances of the request. All desired changes must be timely made in writing to Pegasus.

13. HEALTH/SECURITY/TRAVEL DOCUMENTATION REQUIREMENTS

You must be certain to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities. Pegasus does not assume responsibility for the accuracy or correctness of such health requirements or vaccination and related documentation prior to departure or upon landing at the final destination. See your health practitioner for expert advice.. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the U.S. State Department website http://travel.state.gov, for relevant information relating to travel to specific destinations, and the USA Centers for Disease Control http://wwwnc.cdc.gov/travel/relating to potential health issues. For further information relating to security, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States visit http://www.tsa.govhttp://www.dot.govhttp://www.faa.govhttp://www.ustreas.govhttp://www.cbp.gov for information regarding incidence of disease, terrorism, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States and http://www.uscis.gov/for non-USA citizens. (You must fully inform Pegasus when traveling on a passport from a country other than the USA.) Pegasus neither controls nor warrants the issuance of visas related to applicable travel. Should a visa not be issued, Pegasus is not responsible for lost payments made toward the contemplated trip. Please note that USA rules regarding entry and exit change on a daily basis. 

14. HAZARDOUS MATERIALS; INSECTICIDE NOTICE

USA federal law prohibits passengers from bringing hazardous materials on an aircraft. (1) USA federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. Restrictions on hazardous materials are listed http://www.tsa.gov/traveler-information/prohibited-items and https://www.faa.gov/about/initiatives/hazmat_safety/. You should also check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. Refer to on the DOT’s website, as this list is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinfection-requirements

15. LIMITATION OF PEGASUS LIABILITY

Pegasus is not the source or provider of the travel services. Pegasus acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“supplier(s)”). Each of these suppliers is an independent contractor and legal entity with its own distinct ownership and management, and none of them are owned or controlled by Pegasus in any manner. Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased. You hereby consent to the use of those suppliers, and you are solely responsible to read, understand, and agree to each supplier’s Terms and Conditions, which govern the transaction or trip to which you subscribe. You should request that those Terms and Conditions be made available in printed form and inquire if they are set forth on each supplier’s respective website.. The transportation, accommodations and other services provided by the identified sea, ground, and air transportation, accommodation, and service suppliers offered by Pegasus are also subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by Pegasus, the carriers and other suppliers. BECAUSE PEGASUS ACTS AS AGENT FOR DISCLOSED SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE BUSINESS OR OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, PEGASUS IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE WHICH MAY ARISE OUT OF THESE SERVICES. PEGASUS HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION, LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS, TRANSPORTATION, ACCOMMODATIONS, OR ANY OTHER SERVICES PROVIDED BY ANY SUPPLIER BOOKING THROUGH PEGASUS’ OFFICE OR THROUGH PEGASUS’ WEBSITE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, AND OTHER MATTERS OUTSIDE OF PEGASUS TRAVEL ADVISORS CONTROL, AND YOU HEREBY RELEASE, ACQUIT, REMISE AND EXONERATE PEGASUS FROM ANY LIABILITY WITH RESPECT TO THE SAME.  Pegasus’ sole compensation for services hereunder are limited to certain commissions and fees paid for Pegasus services, and any recovery of damages or recompenses from Pegasus will be limited to the total of commission and fees paid by you and actually received by Pegasus in the twelve (12) months prior to the action giving rise to the liability. 

Pegasus does not in any way assure, promise or guarantee that any particular weather conditions, including but not limited, to the presence or absence of snow, sunshine, rainfall, or other conditions will occur or not occur,. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by suppliers and your travel insurance carrier, and such events are beyond the control of Pegasus. Pegasus reserves the right to cancel any itinerary or any part thereof, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time. Pegasus shall not assume any responsibility for any air or ground schedule changes, or other events or occurrences of Force Majeure (as defined herein) which may stop, impede, or interfere with any planned trip or itinerary booked by or through Pegasus. 

16.  FORCE MAJEURE

In relation to Pegasus in these Terms and Conditions, “Force Majeure” means any circumstances beyond the reasonable control or foreseeability of Pegasus, (including, but without limitation, acts of God, seismic, tectonic, or geophysical activity, explosion, flood, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, adverse or inclement weather conditions, defects in machinery and vehicles, delay, wildlife, or any other unforeseen or unexpected occurrences not within the foreseeability or control of Pegasus).

Pegasus will not be in breach of these Terms and Conditions or otherwise be liable to you by reason of non-performance or delay in performance of any of its obligations hereunder to the extent that any such non-performance or delay is due to Force Majeure. 

If Pegasus or any of its suppliers are adversely affected by Force Majeure, they may in their sole and absolute discretion, elect to vary or cancel any itinerary or arrangement in relation to any trip. Regardless of cause or origin, payment of any refund(s)_ to you by Pegasus or its suppliers as a result of the non-performance of any obligations hereunder for any reason shall be in accordance with these Terms and Conditions as well as those of the suppliers, and any refund payment from Pegasus will be made in Pegasus’ sole and absolute discretion. Provided, however, Pegasus will be entitled to deduct from any refund(s) recoverable the reasonable actual and potential costs and applicable cancellation fees to Pegasus resulting from the Force Majeure or other events. Credits/refunds are not guaranteed due to global events or acts of God.

17.  TRAVEL INSURANCE

PEGASUS OFFERS ACCESS TO MANY OPTIONAL PRODUCTS AND SERVICES TO ENHANCE YOUR TRAVEL EXPERIENCE. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS, ESPECIALLY THOSE CONTEMPLATED BY THESE TERMS AND CONDITIONS.

TRAVEL INSURANCE CAN PROTECT PASSENGERS AND THEIR INVESTMENT. UNLESS SPECIFICALLY OFFERED AND AGREED IN WRITING, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF YOUR ITINERARY TO PROTECT AGAINST ANY OR ALL OF THE FOLLOWING: THIRD PARTY SUPPLIER DEFAULT, BANKRUPTCY, DELAY, INTERRUPTION, MISSED CONNECTION(S) FOR CRUISES, FLIGHTS, AND EXCURSIONS, CANCELLATION, MEDICAL EMERGENCIES, EVACUATION AND REPATRIATION, DAMAGE TO BAGGAGE AND PERSONAL EFFECTS, LOST LUGGAGE AND BAGGAGE DELAY, YOUR ILLNESS, YOUR JOB LOSS, AND ADVERSE EFFECTS FROM CHANGE OF PLANS, ACCIDENTAL DEATH, AND DISABILITY, TRAVEL ACCIDENT, SICKNESS OR MEDICAL EXPENSES, OR ANY OTHER SUCH ADVERSE EVENTS OR OCCURRENCES, FORESEEN OR NOT… Without appropriate travel insurance, if you cancel or interrupt your travel for any reason, portions of the trip or tour costs and expenses may not be otherwise refundable. Pegasus’ and its suppliers’ cancellation penalties will also apply, possibly resulting in the loss of monies up to the full cost of your travel, booking, and related costs. While recommended, the purchase of travel insurance is not required in order to purchase any other product or service offered by Pegasus. Except as otherwise provided and agree by you herein, employees of Pegasus are not authorized to and will not answer questions or give advice about insurance coverages, benefits, exclusions, and conditions of any form of insurance considered or selected by you. If Pegasus procures insurance at your request, there will be additional charges for the insurance and procurement thereof.

18. ALTERATIONS IN TRAVEL PLANS

Alterations in itinerary may be necessitated for any number of reasons; and,  as provided herein, such alterations may be made at the sole discretion of Pegasus, as well as further subject to supplier terms and conditions. A property, supplier, activity, or area deleted from an itinerary for any reason, may be replaced with a comparable one, if possible, in Pegasus’ sole discretion.

19. NO COPYING OR EDITING

No material from the Pegasus website or these Terms and Conditions may be altered, amended, modified, copied, reproduced, republished, downloaded, posted, displayed, transmitted, performed, licensed, used to make a derivative work, transferred, sold, or distributed in any way, without Pegasus’ express and explicit prior written consent. You may not frame or mirror any material on the Pegasus website on any other server or other location. Unauthorized use of Pegasus’ legally protected material on any other website or computer environment or elsewhere is expressly prohibited.

20. RESERVATION OF RIGHTS; CHANGES TO THESE TERMS AND CONDITIONS

Pegasus reserves the exclusive right, in Pegasus’ sole discretion, to change these Terms and Conditions at any time. Updated versions hereof will be posted on the Pegasus website and are effective immediately on posting. You are solely responsible to know about and comply with any and all changes in these Terms and Conditions. Use of the Pegasus website after any changes to these Terms and Conditions constitutes your consent to all such changes.

21. RIGHT TO CORRECT ERRORS; OFFERS SUBJECT TO AVAILABILITY; ENFORCEABILITY; ENTIRE AGREEMENT

We reserve the right to correct errors in Pegasus publications, advertising, and these Terms and Conditions; and, all Pegasus offers are subject to availability and changed circumstances, whether or not foreseeable.

If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect. All other unaffected provisions of these Terms and Conditions will remain unchanged and enforceable as written.

These Terms and Conditions (and any other suppliers’ terms and conditions referenced herein) constitute the entire agreement between you and Pegasus with respect to travel bookings made with Pegasus by any means accessing such information, including the Pegasus website, and these Terms and Conditions supersede and replace any and all prior or contemporaneous communications and proposals, whether electronic, oral or written by and between Pegasus and you, your agents, representatives or designees. A printed version of these Terms and Conditions and your agreement thereto, and of any notice given hereunder in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to your relationship with Pegasus to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in the ordinary course of business.

22. COMMENTS AND POSTINGS 

You are solely responsible for your own comments, the consequences of posting those comments, and the consequences of any reliance by you on the comments of others, whether on the Pegasus website, on social media or otherwise. By submitting your comment on its website, you hereby give Pegasus the right, but not the obligation, to post, edit, exhibit, webcast, reuse, publish, reproduce, use, license, print, distribute or otherwise use your comment(s) and accompanying personal identifying and other information you provide via all forms of media now known or hereafter devised, worldwide, in perpetuity. Pegasus has no responsibility for the content of any messages, information, or materials uploaded, posted, distributed, or transmitted by anyone who uses www.pegasustraveladvisors.com or other websites owned and operated by Pegasus. However, Pegasus retains the right, but not the obligation, in its sole discretion, to monitor, review, edit, delete or refuse to post any third-party content that Pegasus finds to be objectionable, in violation of applicable law, or these Terms and Conditions, or for any other reason or no reason. Pegasus also may disclose any information as necessary to satisfy any law, regulation, court process, or governmental request.

23. GENERAL WEBSITE DISCLAIMER. 

ALL INFORMATION AND MATERIAL ON THE PEGASUS WEBSITE IS CURRENT ONLY AS OF THE DATE IT WAS POSTED. USE OF THE PEGASUS WEBSITE IS AT YOUR OWN SOLE AND EXCLUSIVE RISK. EXCEPT AS OTHERWISE SPECIFICALLY IDENTIFIED IN WRITING HEREIN, THE CONTENT HEREOF IS PROVIDED “AS IS” AND WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. PEGASUS DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. 24. CHOICE OF LAWS, VENUE, AND JURISDICTION

These Terms and Conditions will be governed and interpreted pursuant to the laws of the States of Colorado, notwithstanding any application of conflicts of law. You specifically consent to personal jurisdiction in Colorado in connection with any dispute between you and Pegasus. As parties to these Terms and Conditions, you and Pegasus agree that the exclusive venue for any dispute between the parties arising out of or relating to Pegasus or these Terms and Conditions will be in the state and federal courts in Colorado; provided that Pegasus may o bring legal action against you in any applicable jurisdiction, if you fail to submit as agreed herein to jurisdiction and venue in Colorado, or for Pegasus to enforce any award or order in its favor against you. You irrevocably waive any rights to bring or participate in any class action against Pegasus related in any way hereto.

The information and images contained in these Terms and Conditions, on the Pegasus website, or in any other Pegasus writing, advertisement, or publication, including without limitation downloadable files, are protected by copyright.
